Red Light Running Impossible to Predict

March 13, 2018 | Finz & Finz, P.C.

Pedestrians are significantly more likely to suffer major injuries or be killed if involved in an accident than a driver.  Without the protection of hundreds of pounds of steel to disperse weight, even a minor accident can result in death or disability.  This is particularly true of small children, who have even less mass to absorb any impact.

This sad fact was cruelly illustrated by an incident in Brooklyn on March 5th, 2018, when a driver blew threw a red light and struck and killed two toddlers, along with sending both their mothers to the hospital.  The driver has been arrested, though police have not yet indicated whether or not the driver was under the influence or just driving recklessly.

Pedestrians are taught to follow certain protocols to lower the risk of being hit by a car, but in this situation, it is clear those protocols were being followed.  The pedestrians were in a crosswalk, and the red light should have resulted in drivers stopping.  Unfortunately, many drivers are unsafe, and in those cases there is nothing that a pedestrian can do.

Though a pedestrian can attempt to anticipate whether or not a car is approaching an intersection at an unsafe speed, this type of prognostication is not consistently possible.  Many drivers brake late, and others might blow through a light after appearing to slow down.

If you or someone you love has been injured or killed in a pedestrian accident, you are aware how vulnerable pedestrians are.  Though cities and states can improve the safety of crosswalks and other footpaths, these accidents will continue to happen so long as there are irresponsible drivers.  Please, consult with an experienced attorney regarding your case, and hold the guilty party accountable for their actions.
