Brooklyn Man Charged with Vehicular Manslaughter After Fatal Motorcycle Accident

September 17, 2019 | Finz & Finz, P.C.

The New York Post originally reported on May 27, 2019, that a 23-year-old woman had been charged with vehicular manslaughter, driving while intoxicated (DWI), and unlicensed operator after fatally striking a motorcyclist in Brooklyn. On September 3, 2019, the paper published an updated story that the woman’s 24-year-old boyfriend was arraigned in Brooklyn Supreme Court for 17 counts relating to the same fatal accident.

According to the Post, the woman initially accepted blame for the crash, but the district attorney said that two other passengers that night initially backed up the woman’s claims before admitting the man was actually behind the wheel. The DA also told the Post that a “lengthy” investigation by their office had obtained surveillance footage of the man getting into the driver’s seat of the car involved and text messages in which the passengers were asked to lie to police.

The man pleaded not guilty to 17 counts, including second-degree vehicular manslaughter, second-degree assault, first-degree reckless endangerment, criminally negligent homicide, and conspiracy charges. The Post reported that the man drove 80 miles per hour (mph) in a 25-mph zone and the district attorney said the 2014 Infiniti the man was driving struck the motorcycle so hard that it split the motorcycle in half.

The force of the collision threw the motorcyclist over a median and into parked automobiles on a nearby service road. According to the Post, the victim was rushed to a hospital but could not be saved.

The Post reported that the driver faces up to 15 years in prison if he is convicted of the top count. The woman is facing conspiracy and obstruction charges.
