Unsafe Tour Bus Practices Post Danger to Passengers
October 02, 2017 | Finz & Finz, P.C.
If you were to sit down and design the most unsafe situation for a passenger on a tour bus, you would look at three things: the driver, the bus, and the environment. Evaluating each, you would determine what details each might possess that would increase the risk of a dangerous accident occurring. And, even if you tried, you might fail to create a situation as dangerous as the one that left 3 dead and 18 injured in New York City on September 18, 2017.
The driver was a clear danger to himself and others. With a recent history of dangerous driving, including an accident, he may also have been under the influence of drugs or alcohol. Police are still concluding their investigation, but it is reasonably likely that the driver was impaired in some way-in addition to his long history of speeding and other unsafe behaviors. In fact, the driver had been previously fired from the MTA in 2015.
The bus itself was owned by a company with a history of flouting safety rules. Dahlia Inc. was recently involved in a bus crash in Connecticut that resulted in a fatality. User reviews on various online sites indicate that many people who have encountered Dahlia Inc. busses, both as riders and as other drivers sharing the road, have identified a litany of unsafe driving practices.
The environment, a densely packed urban area, makes safe driving more difficult. New Yorkers know how important it is to be able to deftly navigate traffic, and how important following the rules of the road is. In this situation, the driver was speeding and ignoring traffic signals, and the layout of the road left other drivers unable to respond.
If you or someone you love has been injured in a bus or auto accident, identifying what unsafe practices might have contributed to the injury is important. Too many drivers and companies flagrantly ignore proper safety protocols. Please, consult with an experienced attorney who can walk you through the process of making your case.
