A Queens sanitation worker tragically died in September in Douglaston, Queens. The incident involved Richard Errico, a 54-year-old sanitation worker with 19 years of service. The tragedy underscores the risks sanitation workers face daily despite recent efforts to improve safety standards.

How Was the Queens Sanitation Worker Killed?

Richard Errico fell from his truck while attempting a U-turn near the Queens East Sanitation Garage shortly before 6 p.m. on September 21, 2024. After falling, he slipped beneath the wheels of the 65,000-pound truck and died instantly.

Investigators have not yet determined why he fell, but sanitation workers frequently leave their truck doors open to allow for easier access while working. Officials believe the common practice may have played a role. The NYPD’s Collision Investigation Squad is reviewing the incident as part of the standard procedure for workplace fatalities.

Who Can File a Wrongful Death Lawsuit in New York State?

In New York State, only the personal representative of the deceased’s estate can file a wrongful death lawsuit. The person appointed by the Surrogate’s Court acts on behalf of the estate and the beneficiaries. Only surviving spouses, children, parents, or other dependents can benefit from the lawsuit. The wrongful death claim must prove that someone else’s negligent or reckless actions directly caused the death.

The compensation from a wrongful death lawsuit aims to address the financial and practical impacts of the person’s death. Recoverable compensation in a New York wrongful death lawsuit can include funeral and burial expenses, medical bills incurred before death, and lost income the deceased would have earned. Families can also recover compensation for the loss of parental guidance, emotional support, and household services. New York law does not allow compensation for emotional suffering experienced by family members in wrongful death lawsuits.

Fatal workplace accidents also frequently entitle certain surviving family members to benefits through the workers’ compensation system. Our experienced wrongful death lawyer can review your case to determine the types and amounts of compensation you could recover for your loss.
