The cesarean section should have been preformed as soon as it was determined that the infant was in fetal distress (bradycardia). Due to the failure of the doctor and hospital to deliver the baby sooner, the child was in prolonged fetal distress that resulted in the delivery of a brain damaged infant. The infant survived for 15 months.
