The backyard had a raised patio with flower pots placed at the edge of the patio. The position of the flower pots were not fully situated on the patio.
As our client was running past the patio to find a hiding spot she bumped into one of the flower pots causing it to fall and strike her right leg. Our client sustained a fracture of the right distal femur and underwent closed reduction and placement of a cast. As a result of her injury she continues to have pain and discomfort in her right leg.
A lawsuit was commenced charging the owner of the home with negligently placing the flower pot at the edge of a raised patio. After full discovery, a trial date was set in Nassau County Supreme Court. The action was settled just prior to jury selection.
