This medical malpractice case pertained to a delayed diagnosis and treatment of Thiamine (Vitamin B1) deficiency in a 59-year-old man following cancer treatment. The defendant hospital failed to render a proper diagnosis, resulting in the development of Wernicke’s Encephalopathy, an acute and severe brain disorder that requires immediate administration of Thiamine. Because appropriate treatment was not provided, the condition progressed to Korsakoff’s Syndrome, leaving our client with permanent neurological impairment.

The defense took the position that the case had limited value, disputing causation and contending that our client’s pre-existing conditions and prior cancer treatment were the primary factors in his neurological deficits. Extensive depositions were conducted of both defendants and non-party fact witnesses. Expert support was secured from multiple medical specialists. In addition, our client was examined by a board-certified neurologist, who would have testified at trial on our client’s behalf regarding the full extent of his permanent neurological injuries.

During trial preparation, the parties agreed to mediation and the case settled for $3,000,000.
