An MRI of the brain showed greater than 90% occlusion of the middle cerebral artery. After consulting with her neurologist, he should have referred her to a neurosurgeon but failed to do so. As a result, her condition went untreated and she suffered a stroke. She was thereafter diagnosed by a subsequent treating doctor with a rare condition known as Moya-Moya Disease. This is a cerebrovascular disease that requires surgical intervention. As a result of the neurologist’s failure to refer our client to a neurosurgeon her Moya-Moya progressed over 14 months and she then suffered a hemorrhagic stroke.

The defendant took a hardline position prior to trial claiming that it was her Moya-Moya disease that resulted in her stroke and that early neurosurgical intervention would not have prevented the stroke. Our firm assembled a top team of medical experts and after weeks of trial in Nassau County Supreme Court a settlement was reached just prior to verdict.
