The contact resulted in serious personal injuries.The plaintiff was air lifted to an upstate New York hospital where he received care and treatment for his injuries including surgery for a fractured left leg and pneumothorax . After the initial discovery proceedings had taken place, the defendant’s insurance carrier tendered its full insurance policy in the sum of $1,000,000. The plaintiff, a Pennsylvania resident, maintained underinsurance coverage.
