Our client, a lifetime New York City resident, was descending the stairs of a Manhattan subway station when her ankle turned on an unleveled surface in the walking area of the steps. She suffered a knee injury requiring surgery. The attorney at Finz & Finz, P.C., asserted that the step was constructed improperly, contributing to the 74-year-old woman’s fall. The New York City Transit Authority denied any responsibility and vehemently maintained that there was nothing wrong with the steps, while taking a no-pay position. The case went to trial in Manhattan Supreme Court. The intense trial preparation together with biting cross-examination of the Transit Authority witnesses by Finz & Finz, P.C., trial attorney forced Transit to charge its no-pay position. The case was settled during trial in the sum of $140,000 and justice was achieved.
