This medical malpractice action arose from the delayed diagnosis and treatment of an infection in a 30-year-old woman following medical management of an ectopic pregnancy, in which a fertilized egg implanted outside of the uterus. Our client was treated by physicians at the defendant hospital, who negligently permitted an infection to progress without proper administration of antibiotics. Our client developed sepsis, then septic shock, and suffered three episodes of cardiac arrest. After a complicated hospital course, including the placement of a pacemaker, our client made a significant recovery and eventually returned to work and was able to care for her family.

The defense took the position that the case had limited value, disputing liability and causation and contending that our client’s injuries were unavoidable. They argued that the doctors did nothing wrong and that appropriate interventions would not have prevented the complications, and therefore, the damages were speculative.

Our litigation strategy was successful in uncovering critical evidence undermining these defenses. We conducted extensive depositions and successfully filed a motion to compel an additional deposition of the target defendant. This case was fully prepared for trial with several top-quality expert witnesses, including specialists in obstetrics/gynecology, emergency medicine, infectious disease, cardiology, radiology, and pathology.

Faced with compelling evidence of negligence and the prospect of trial, the defense agreed to settle this case during a Pre-Trial Court Conference in the sum of $4,000,000.
