Gasper Vallejo, 32, lost control of his 2016 Mercedes C26 while attempting to change lanes at approximately 3:30 a.m., slamming it into a support pillar with such force that it sheared the vehicle in half and ejected all three of its occupants. A 22-year-old female passenger sitting in the back seat was also killed, while the 25-year-old female passenger sitting in the front seat was taken to Lincoln Hospital in critical condition.

The speed limit on that part of Bruckner Blvd. is 30 miles per hour.

Passengers and Auto Accidents

Passenger injury claims are typically either first party claims or third party claims. A first party claim is filed against the individual’s own insurance provider in the eventuality that the at-fault driver has no insurance, or inadequate insurance. A third party claim, though, is filed against the at-fault driver or their insurance company — whether that driver was operating the vehicle in which the claimant was a passenger, or another vehicle involved in the accident.

Whether you file a first party claim or a third party claim will depend on the circumstances of the accident in question. A lawyer can help you determine which course of action to pursue.
