In order to succeed in a lawsuit against New York City for a raised or broken plank that results in a fall and injury, it is required that the City either have prior written notice of the condition or that the City created the condition that caused the fall.

Although in the early stages of this contested case NYC denied liability, after intense depositions and document demands and exchanges, the case was settled just prior to jury selection in the sum of $575,000.
