Workplace Accidents Posed by Holiday Deadlines

December 11, 2017 | Finz & Finz, P.C.

The holidays are an exciting time.  People are buying gifts for the people they love, for friends, and for coworkers.  And more and more people are doing their shopping online, using Amazon and other retailers to save themselves the hassle of going to the store themselves.

This increased online ordering also means that shipping companies are busier.  Fedex, UPS, and the United States Postal Service manage massive numbers of packages, doing their best to get them where they need to be as quickly and efficiently as possible.  More packages means moving faster and doing their best to utilize machines, such as forklifts and sorting machines, to try to expedite shipping as much as they possibly can.

A Fedex worker in Memphis, Tennessee is dead, crushed by a mobile conveyer belt early Thanksgiving morning.  This is the third death in the last four years at just that one facility, prompting calls for changes to improve safety.  Safety is frequently the first thing to go when ramping up speed and efficiency for the holidays.

Knowing whether or not the company was negligent can be difficult, and proving it can be even harder.  But in this case, there are indications Fedex did not prioritize safely.  The worker was found dead, and it is not certain how long after the accident the body was found.  Though there are reasons a person might be working alone, a person utilizing potentially dangerous machines should not be completely unmonitored.

If you or someone you love has suffered an on-the-job injury, determining whether or not proper safety protocols were developed and followed is massively important.  Please, contact an experienced attorney to help you evaluate the situation and determine whether or not safety was given the importance it deserves.
