Drivers Must Be Particularly Aware of Pedestrians in Icy Conditions

January 10, 2019 | Finz & Finz, P.C.

Attentiveness to surroundings is always important when driving, but even more so when icy conditions hinder your ability to brake quickly.  Though keeping focused on the road in front of you is an excellent way to reduce the risk of a motor vehicle accident, checking peripheries and keeping an eye out for pedestrians can be the difference between life and death for someone on foot.

Icy conditions affect both drivers and pedestrians in a variety of ways.  For drivers, slick conditions increase the likelihood of drifting or sliding when braking.  Sliding forward is dangerous for those crossing the road in front of you, and the possibility of drifting while turning introduces the possibility of sliding into someone on a sidewalk corner.  Before making turns and when approaching busy intersections, the driver should be particularly cautious about pedestrians.

For pedestrians, the biggest increased risk for being hit by a car in icy conditions comes from the likelihood of slipping and falling.  Whether crossing a slippery crosswalk or navigating a sidewalk, a person who slips can end up sliding into the roadway and being hit by the car.  A person who falls while crossing a street can be struck by a motorist who is going too fast and is unable to stop, or a by a driver who does not notice the prone person in front of them.

If you have been injured in a pedestrian-motor vehicle accident, determining whether or not the driver paid proper attention to their surroundings is an important factor in making your case.  Please consult with an experienced lawyer regarding the particulars of the incident in order to make sure that you proceed in the best way possible towards getting the compensation you are entitled to.
