Unlicensed Daycares: Don’t be Tempted by the Price

October 16, 2013 | Finz & Finz, P.C.

When searching for the perfect daycare for your child, it is no surprise that there may be some unlicensed daycares in the mix, whether you realize it or not. With so many of the centers offering various features, it maybe temping to go with a daycare center that has a lower price offering than others you have explored.  A word of caution:  don’t be tempted by the price when it comes to the welfare of your child.  A quality center will be up front with fees and offerings.  And, don’t think your next door neighbor is above it all in providing the best care for your kids – that person could be in the category of “unlicensed daycare” if the person takes on three or more children.

We want what is best when it comes to our kids and how to take care of them. We know that no one can do this better than we can.  But, what about when your neighbor offers to watch your kids in exchange for watching theirs occasionally, or offers you a reduced rate because they know you’re having a hard time finding a quality center?  Just because the person is a great mom and a good neighbor might not mean she meets the qualifications for a good daycare provider.  There are certain qualifications that must be implemented or you could find yourself with a completely different lawsuit if an injury were to arise.

A licensed daycare has a staff that is trained and professional.  The center should be licensed, bonded and insured.  These are good signs to look for when enlisting a center.  Those daycare centers who do not take the time to get themselves licensed puts them in the category of substandard care—not a good category when it comes to your children.

Here are some things to keep in mind when seeking out the perfect center for your child.

  • The first thing to do is ask if the center is licensed. If it is not, continue your search.
  • Ask the Better Business Bureau if there have been any incidents involving that particular center.  If there are, continue your search.
  • Look at the cleanliness of the center.  If the place is not clean, it’s a sure sign that they are unregulated by anyone who is paying attention to regular inspections.  Continue your search.
  • How many children per caregiver are being tended at the center?  Are ten kids being watched by a sick employee?  That could mean there is no license.

What happens when your child is injured at a day care center?  Many fingers point, and no one wants to be the one to admit you that your child was hurt.  We know kids will be kids, and the younger they are, the less likely they are to tell us what happened.  Details will be hard to find when an incident has already occurred, and cover-ups could ensue again. Before an injury occurs, do your homework for the betterment of your child.  And, if your child is injured at a daycare, enlist an attorney who can best handle your case for personal injury.
