New York High Court Sets Further Legal President to Hold NYC Responsible for Injury due to Dangerous Road Conditions

In a decision that will have a serious impact on the outcome of lawsuits involving car, bicycle, and pedestrian accidents, the highest court in New York State has ruled that cities and other municipalities can be held responsible for accidents on dangerous roads. The ruling stems from the case of a 12-year-old Brooklyn boy who was seriously injured when he was struck by a car while riding his bicycle on a road well-known for excessive speeding.

Gridlock Shows Even the Simplest Road Design is Not Always Effective

Every year the New York City Department of Transportation releases its list of Gridlock Alert Days for the holiday season in an effort to keep traffic moving on the busy streets. It is recommended that residents, commuters and tourists rely on trains, buses and subways to get around Manhattan. If the weather cooperates, walking and bike riding is also an option to avoid sitting in non-moving traffic.

Finz & Finz, P.C. Wins Important Motion against Nassau County on Road Design Defect Case

Finz & Finz, P.C. commenced an action against the County of Nassau on behalf of a client who suffers from brain damage as a result of a single-car accident, alleging that the accident occurred as a result of the County’s negligence in failing to conduct a study of the traffic conditions at the accident location.  As a result, the County negligently placed a traffic warning sign, which was intended to warn drivers that the road ahead curved, behind foliage, which impeded the plaintiff’s ability to see the sign.  As the plaintiff did not have time to properly navigate the curve, he lost control of his vehicle and crashed into a tree.

Stay in the Zone During Road Construction

It never fails.  No matter what time of year, there is always road work to be done.  As drivers, we see this as a huge temporary inconvenience as we have to wait for the lead vehicle to direct us where to drive, or drive our car much slower than normal for long periods of time when we’re rushing from one place to the next.  And, what about the added conditions of ice, snow or rain during the construction period?  This means inconvenience times ten.  While we can generally appreciate the newer safer road once the work has been completed, it’s important to still pay attention in these areas while the road work is taking place.
